Public Procurement Service Overseas Procurement Market Expansion Support System User Agreement
(Public Procurement Service Notification Issue 34, December 1st, 2015)

Section 1- General Provisions
Article 1(Purpose)
These provisions serve to address the terms and conditions of use of the 'Public Procurement Service Overseas Procurement Market Expansion Support System' (henceforth referred to as 'Export Support System' ) operated by the 'Public Procurement Service'.
Article 2(Definition of Terms)
The definitions of the terms used in these provisions are as following.
1. “Export Support System” refers to the system of the G-PASS company’s overseas procurement market expansion support, which is operated/managed by the Public Procurement Service in accordance to 6 of Article 3 of the 「Governement Procurement Act」, and is composed of the overseas procurement information center and Global Korea Market.
2. “Member” refers to an individual who has accepted the Public Procurement Service and Export Support Systems terms of use, and received an ID. 3. “Member ID” refers to the combination of characters and numbers requested by the member, for identification and for the use of the Export Support System.
4. “Password” refers to the combination of characters and numbers set by the member during, or after, registration, used to confirm the correspondence of the user and the ID, and to protect information.
5. “Terms of Use” refers to the contract signed between the manager and user for the services provided by the site. 6. “Withdrawal” refers to the termination of the terms of use and cancellation of the membership by the user.

Article 3(Effective Date and Policy Amendment)
① This clause is in effect with the notification by the Public Procurement Service on the Export Support System, and the agreement by the member.
② The Public Procurement Service may make changes to the terms and conditions at its discretion, provided that the changes are within reason and do not violate the Regulation of Standardized Contracts Act, the Promotion of Information and Communications Network Utilization and Information Protection Act, and other related laws. In the case of amendments, the Public Procurement Service will notify the reasons and contents of the amendment, at least 7 days before the changes are put into effect.
③ The changes in terms apply equally to members registered before the changes, and members who do not wish to accept the amendments are free to request for the cancellation (or withdrawal) of their membership.
④ The continued use of services after the effective date of the amendments will imply that the member has agreed to the changes in policy.

Article 4(Provisions Applicable Mutatis Mutandis)
Terms not explicitly mentioned in these terms and conditions follow the 「Consumer Protection Act」, 「Framework Act on Electronic Commerce」, 「Framework Act on Consumers」,「Promotion of Information and Communications Network Utilization and Information Protection Act」,「Government Procurement Act」, 「Offshore procurement markets industry designation and management regulation」,「Public Procurement Service overseas procurement markets support system operation regulations」, and other related laws and regulations.


Section 2 Terms of Use of Service
Article 5(Terms of Use Establishment and Data Collection)
① The terms of use will be established as the agreement to the contract by the user and as the approval of use of services by the Public Procurement Service. The following information will be collected in relation to the provision of service.
1. Company Representative Information
- Name, ID, password, phone number, email address, address
- Optional information entered by the member, or information entered out of choice
- Information necessary for the provision of miscellaneous services and member management
2. Company Information
- Company name, corporate registration number or other identification number, ID, password, phone number, email address, address
- Optional information entered by the member, or information entered out of choice
- Information necessary for the provision of miscellaneous services and member management
② In order for the member who has agreed to the terms of use of the Export Support System to use the various services provided by the system, the Public Procurement Service may collect information entered in the form during registration and information updated after, during the period of service provision.

Article 6(Application of Use)
The application of use is established upon the agreement of the terms of use of the Export Support System, and the filling out of the membership registration form selected by the Public Procurement Service.
Article 7(Approval of Application of Use)
The Public Procurement Service will follow the process outlined in this terms of use, and approve the use of services upon the accurate completion of the registration form and agreement of the terms of use as a ground rule.
Article 8(Terms of Use for Overseas Buyer Members)
Despite article 5 and article 7, in the case of overseas buyer members, if the applicant completes the registration form and agrees to the terms of use, the applicant may use the services set for overseas buyer members without the need for the approval process.
Article 9(Application of Use Rejection)
Despite article 7 and article 8, if the applicant has a record of violating these terms of use or related laws, the application violates these terms, or if they commit the following issues, the Public Procurement Service reserves the right to deny approval or limit use without any notice.
1. Entering false information for the application
2. Using someone else’s identity for application
3. If other requirements for application is incomplete or inadequate

Article 10(Changes to the Contract Terms)
If the registration information changes, members may edit the information by requesting for the editing of information through the Export Support System.



Section 3 Duties of the Contracting Parties
Article 11(Duties of the Public Procurement Service)
① The Public Procurement Service has the duty to provide consistent service in accordance to these terms of use.
② The Public Procurement Service must seek the proper technical and management security measures to ensure that the information the members provided does not become lost, stolen, leaked, altered, or damaged.

Article 12(Duties of Members)
① Members must keep membership and other information up to date in the use of the Export Support System.
② As they have agreed to the terms of use of the Export Support System, members will be considered to have agreed to receive mail from the management and to be searchable and be able to be contacted by other members.
③ Members must abide by the policies of this agreement and related laws.

Article 13(Copyrights and Duties of Posts by Members)
① Members must maintain/update their registration information, and be responsible for their posts.
② The copyrights of the post belongs to the posting individual, and members may not alter, sell, or use information gained from the Export Support System, for commercial purposes.
③ Members must not post contents that disturbs public order, violates the copyrights of a 3rd party, or infringes on any other rights.

Article 14 (Transfer Prohibition)
Members may not share or give their rights to service or position to someone else, and can not provide them as collateral.



Section 4 Contract Termination and Usage Limitation
Article 15(Contract Termination and Usage Limitation)
① If a member seeks to terminate the contract, the member must personally fill in the application form to apply for the termination, and the Public Procurement Service must take appropriate measures after confirming the identity of the applicant.
② If the member commits any of the following acts, the Public Procurement Service reserves the right to terminate the contract or discontinue service without prior notice.
1. If they are not the subject of membership application, or has submitted a false application
2. Theft of another member’s ID or password, or an individual registering with multiple ID’s
3. Not responding to the request by management for files related to the confirmation of registration information
4. Sending information en masse or sending advertisements to intentionally disturb operation stability
5. Replicating or providing information gained from the Export Support System, to a 3rd party for purposes that violate the purpose of the system, or for inappropriate use
6. Committing acts that violate the purpose of the services provided by the Public Procurement Service, or prevent the smooth operation of the service
7. Committing acts that undermines the authority, honor, credit, or other fair profits of the Public Procurement Service, members, or other people
8. Causing criticism by violating business ethics, or hindering sound and fair trades
9. Circulating contents that disturb public order
10. Committing acts that violate these terms of use or other related laws
11. If the Public Procurement Service deems the purpose to not correspond with the purpose of the Export Support System

Article 16(Member Post Management and Deletion)
For efficient service operation the storage memory, message size, storage date may be limited, and if they fit the following criteria, may be deleted without prior notice.
1. Slandering or undermining the authority, personal information, honor, credit, or fair profit of the Public Procurement Service, members, or a 3rd party
2. Disturbing the public order
3. Posting illegal materials, obscene materials, or content harmful to minors, or advertising or sharing links to related contents
4. If the post violates the intellectual property copyright of another person
5. Registering counterfeit products that violate the trademark holder’s rights
6. If the post is deemed inappropriate for the purposes of the Export Support System by the Public Procurement Service



Section 6 Miscellaneous
Article 17(Service Hours)
Provided that there are no operational or technical difficulties, the ground rule is that service is available 24 hours a day, everyday.There is an exception when there are inspections or other issues.

Article 18 (Site Ownership)
① The services provided by the site, the necessary software, images, mark, logo, design, service name, information, brand, and any other related intellectual properties belong to the Public Procurement Service.
② Users may not alter, rent, loan, sell, distribute, manufacture, transfer, relicense, or set as security right, the properties, in part or as a whole, mentioned in the section 1 above, nor can they give permission to a 3rd party to perform the acts mentioned above.

Article 19 (Exemption Clause)
① The Public Procurement Service will not be responsible for the losses caused by not abiding by the terms of use.
② The Public Procurement Service will not be responsible for the damages or loss caused by the errors, omission, and quality of information provided by other members.
③ The Public Procurement Service does not have the duty to involve itself in the dispute or situation caused by members and a 3rd party service, and is not responsible to compensate for the damages caused.

Article 20 (Settlement of Disputes)
① The laws of the Republic of Korea are in effect regarding the service contract between the Public Procurement Service and members, and trades between members.
② In case of a dispute regarding these terms of use, a settlement between both party’s will be a priority, but if a settlement can not be reached it will be settled with a lawsuit, and the jurisdiction of court will be held by the court that has jurisdiction of the Public Procurement Service.


Supplementary Provision <Article 34, 2015 December 1>
Article 1(Enforcement Date) This regulating is enforced starting December 1, 2015
